Terms of Service

These Terms govern your use of carelinkja.com and the CareLink Jamaica platform (the “Service”). By creating an account, posting a job, applying for a job, or making or accepting a booking, you agree to these Terms.

1. What CareLink is — and is not

CareLink Jamaica is a marketplace that connects parents (“Parents”) with babysitters and nannies (“Sitters”). CareLink is not the employer, agent, or partner of any Sitter, and Sitters are independent contractors who set their own rates and availability. CareLink does not provide childcare directly.

2. Eligibility

  • You must be 18 or older to register.
  • Sitters must be legally entitled to work in Jamaica.
  • You agree to provide accurate information and keep it up to date.

3. Account responsibility

You are responsible for everything that happens on your account. Keep your password private. Tell us at hello@carelinkja.com immediately if you suspect unauthorised access.

4. Bookings and payments

How a booking works

  1. Parent requests a booking; Sitter accepts or declines.
  2. Once accepted, the booking is binding for both parties.
  3. Payment is handled per the Parent's chosen method (cash, bank transfer, Lynk, WiPay card, or PayPal).
  4. For card / PayPal: funds clear and CareLink's platform fee is deducted (10% on WiPay, 12% on PayPal).
  5. For cash / bank transfer / Lynk: Parent pays Sitter directly; CareLink charges no platform fee.

Platform fee

CareLink charges 0% on cash, bank transfer, and Lynk bookings, 10% on WiPay (card) bookings, and 12% on PayPal bookings. Fees are paid by the Parent on top of the Sitter's rate; Sitters always keep 100% of their listed rate.

Cancellation

  • Parent cancels > 12 hours before start: full refund (card / PayPal) or no obligation (cash / bank / Lynk).
  • Parent cancels < 12 hours before start: 50% of the booking value goes to the Sitter.
  • Parent cancels < 2 hours before start, or no-show: 100% goes to the Sitter.
  • Sitter cancels: full refund to Parent. Repeated Sitter cancellations may result in suspension.

Disputes

If a Parent has a complaint (sitter no-show, conduct, safety issue), they must report it within 48 hours of the booking end via disputes@carelinkja.com. CareLink mediates in good faith and may withhold or refund payments held in escrow (WiPay) accordingly. Cash / bank / Lynk disputes are between the parties directly; CareLink will assist but cannot reverse a transfer it never held.

5. Sitter conduct + verification

  • Sitters must hold a valid JCF Police Certificate to be marked “Verified”.
  • Sitters must accurately represent their experience, qualifications, and availability.
  • Sitters must follow lawful instructions from Parents during a booking.
  • Any abuse, neglect, or endangerment of a child results in immediate, permanent suspension and may be reported to the Child Protection and Family Services Agency (CPFSA) and/or police.

6. Parent conduct

  • Treat Sitters with respect; harassment, discrimination, or threats result in suspension.
  • Pay agreed amounts on time per the chosen method.
  • Provide accurate information about the children, the home, and any safety considerations.

7. Reviews

Reviews must be honest and based on actual bookings. Defamatory, false, or retaliatory reviews will be removed and may result in account suspension.

8. Liability

CareLink connects Parents and Sitters. We are not liable for the conduct, actions, or omissions of any Parent or Sitter, the safety of the booking environment, or any incident, injury, loss, or damage that occurs during a booking. Each party is responsible for their own decisions in entering into a booking. To the maximum extent permitted by Jamaican law, CareLink's aggregate liability to you for any claim arising from your use of the Service is limited to the platform fees you have paid CareLink in the 6 months before the claim arose.

9. Indemnity

You agree to indemnify CareLink against any claim brought by a third party arising from your breach of these Terms, your unlawful conduct, or any harm you cause during a booking.

10. Suspension and termination

We may suspend or close any account that breaches these Terms, harms another user, or threatens the integrity of the platform. You may close your account at any time. Some records (booking history, financial records) are retained per our Privacy Policy.

11. Intellectual property

The CareLink name, logo, AI matching prompts, blog posts, and site design are the property of CareLink Jamaica. You may not copy, scrape, or republish any part of the Service without written permission.

12. Changes

We may update these Terms. Material changes will be announced in-app or via WhatsApp at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of Jamaica. Disputes between you and CareLink that cannot be resolved by good-faith negotiation will be heard in the courts of Jamaica.
